Jean
Martel becomes a member of the Board of Directors
of the Business Development Bank of Canada
On September 21, 2006, the
Honourable Maxime Bernier, Minister of Industry
and the minister responsible for the Business
Development Bank of Canada (BDC), named
Jean Martel
to the BDC’s Board of Directors. He summarized
the reasons for appointing Mr. Martel as follows:
[translation] "His knowledge and expertise in
the areas of law and finance make Mr. Martel an
asset to the BDC. His contributions will be of
great value to the Board of Directors, which
continues to foster the development and growth of
Canada’s entrepreneurs."
Jean Martel joined Lavery, de Billy in 1999 as a partner after having held various key positions, including that of President of the Commission des valeurs mobilières (Quebec Securities Commission), which he held from 1995 to 1999.

the American College of Trial Lawyers
Raphaël Schachter
has been elected Quebec President of the
prestigious American College of Trial Lawyers.
With 54 Fellows in Quebec, this organization
brings together the best trial lawyers in the
United States and Canada.
Several veteran Quebec lawyers are members of the committee chaired by Raphaël Schachter, of which Michel Yergeau is also a member. They are George R. Hendy, Max R. Bernard, Christine A. Carron, Guy Du Pont, Lynne Kassie, Michel Jolin, Raynold Langlois, Sylvain Lussier, Simon V. Potter, Gérald R. Tremblay and Michel Décary.
Fellowship in the College is
extended only to experienced trial lawyers who
have mastered the art of advocacy and whose
professional careers are distinguished by the
highest standards of ethical conduct,
professionalism, civility and collegiality.
Membership in the College cannot exceed one per
cent of the total lawyer population of any state
or province. Within our firm,

Brière becomes the first holder of a major chair
at the Université Laval
On September 28th, Jules Brière
was officially appointed first holder of the
Université Laval’s Louis-Philippe-Pigeon Chair
in Legal Writing, at a reception organized by the
Dean of the Faculty of Law, André Lareau.
The Honourable Michel Bastarache, a Supreme Court of Canada judge, and Michel Pigeon, the Rector of the Université Laval, participated in this event to highlight the appointment of our colleague, who has a long history in teaching, having begun his career as a law professor.
The Quebec
Bar chooses Jean Saint-Onge to chair its
advisory committee on class action proceedings
Jean Saint-Onge
has recently been named chairman of the Quebec Bar’s
brand-new advisory committee on class action
proceedings comprised of experienced defendants’
and plaintiffs’ lawyers. The Coordinating Judge
of the Class Action Division, the Honourable
André Prévost, will also serve on this committee
as a consultant.
The committee’s mandate is to
initiate reflection on the practice of law in
class action proceedings and think about new
procedural tools likely to facilitate management
of class actions.
In assuming the chairmanship of this committee, our partner Jean Saint-Onge continues his dedicated involvement in the work of the Quebec Bar.

Pierre Beaudoin contributes to the creation of the Groupe Arbitrage et Médiation Thémis
Our Quebec City office participated in the creation of this group of lawyers from the largest firms in
Quebec. It is made up of one lawyer from each firm.
Pierre
Beaudoin, a partner based in our Quebec City office, is our firm’s representative within the group.
The Groupe Arbitrage et Médiation Thémis offers the services of a group of seasoned lawyers to businesses and members of the legal, accounting, medical and other professions. To ensure exemplary effectiveness, the members of this new group have agreed to offer a flexible approach but firmness in
implementation.
You may recall that in Greek mythology, Themis personifies Justice and Law. She appears with scales and a sword in her hands, which represent Justice. Her blindfolded eyes symbolize the impartiality of her decisions.

Defence Lawyers Association
Brian
Elkin, managing partner of our Ottawa office, was appointed vice-president of Canadian Defence Lawyers at its general meeting held on June 1st, 2006, in Toronto.
This professional association’s members are defence lawyers from across Canada. It is associated with the Defence Research
Institute, its U.S. counterpart, which brings together more than 20,000 defence
lawyers.
Evelyne Verrier to co-chair an innovative conference
on disability insurance
Evelyne Verrier will co-chair the Insight conference entitled “Assurance invalidité – Prévention et gestion des réclamations et des litiges”
[Disability Insurance – Prevention and Management of Claims and
Litigation] to be held at the InterContinental Montreal hotel on November 14th and 15th, 2006.
This conference, described as « innovative » by its co-chairwomen, is aimed at informing participants about the latest disability insurance developments, to enable them to manage claims and related litigation more
effectively.
The event will bring together a panel of speakers from the largest firms in Quebec, as well as the medical and university
sectors.
Ms. Verrier is considered as an authority in this area of expertise. She distinguishes herself especially on the basis of her university education in actuarial sciences.
The firm contributes to the Marie-Vincent Foundation’s
record fund-raising
Chaired by our partner Jean Saint-Onge since 1996, the Marie-Vincent Foundation has achieved the best fund-raising year in its
history.
At its June 14th, 2006 fund-raising show, the Foundation announced that the generosity of the businesses and individuals who support its mission resulted in over one million dollars in donations. The initial objective was $850,000.
Lavery, de Billy, along with many of its clients, were among the firms contributing to the 2006 fund-raising campaign, of which
Claude Guévin, Senior Vice-president and CFO of RONA, was the Honorary
President.
The mission of the Marie-Vincent Foundation is to prevent all forms of abuse of children under 12. It also assists young victims, mainly by supporting the Marie-Vincent Centre specializing in sexual aggression.

Jean-Pierre Casavant will co-chair a Canadian Institute conference on October 23rd and 24th, 2006, at the Hotel Omni Mont-Royal. The theme of this event will be “La gestion des litiges d’assurance responsabilité générale et de biens”
[Managing General Liability and Property Insurance
Litigation].
Robert W. Mason will participate in the conference as co-chair of a workshop on environmental disasters and their practical impacts on general liability and property
insurance.
Messrs. Casavant and Mason have both acquired international reputations in the field of
litigation.

Managers learn about employers’ investigative powers
The recent breakfast discussion organized by our Labour and Employment Law Group drew over 90 people on June 15th in
Montreal. Dealing with employers’ investigative
powers, the presentations by two of our partners,
Michel Gélinas and
Érik
Sabbatini, captivated the participants, who gave the conference a very positive
evaluation. The speakers provided a lively and detailed presentation of the jurisprudence and best practices in this field.
Jean Saint-Onge will moderate the Quebec Bar’s symposium on class actions
Jean Saint-Onge will moderate the second symposium on class actions under the Quebec Bar’s continuing education program this October 26th and 27th. The theme is “Class Actions: Recent Developments in
Quebec, Canada and the United States” and this event will bring together speakers in private practice from
Quebec, the rest of Canada, the United States and France, as well as representatives of the
judiciary.

Pierre Baribeau joins the Advisory Committee of the UdeM Faculty of Medicine
Pierre Baribeau has been invited to join the Advisory Committee of the Dean’s Circle of Excellence of the Faculty of Medicine of the Université de Montréal. Chaired by Hélène
Desmarais, President and Chief Operating Officer of the Centre d’innovation et d’entreprises de Montréal, the Committee’s role is to inform the members of the Circle about the main issues faced by the
Faculty. Senior executives of several pharmaceutical companies also serve on the
Committee.
Élisabeth Pinard contributes to the positioning of
Université Laval
Élisabeth Pinard has been appointed Ambassador of the Cercle international Rouge et Or of Université Laval which has the mission of helping the university assure its positioning in Europe and North
America.
Ms. Pinard also chairs the board of directors of the university’s
foundation.
Jean-Simon Deschênes joins two boards of directors
Recently, Jean-Simon Deschênes was named to the board of directors of the Jeune chambre de commerce de Québec, became President of the Quebec Chapter of Junior Chamber International Canada (JCIC) and was named to its national Board of
Directors. With 40 local chapters, the JCIC is affiliated with the Junior Chamber International
(JCI), a worldwide movement made up of business people from 18 to 40 years of age, and is active in over 110 countries and
territories.
